Terms of use

These terms are the agreement between you and us for using Suvi. They are written in plain English. Nothing in them takes away rights you have under the Australian Consumer Law.
About these terms
Suvi is provided by [to confirm: business name and ABN of whoever runs Suvi] ("we", "us"). "You" means the person or business with a Suvi account. By creating an account or signing in, you agree to these terms and our privacy policy.
Suvi is for people running a business, such as independent support workers, youth workers and small providers. You must be 18 or over, and you use Suvi for your business, not for personal or household purposes.
Testing period
Suvi is being tested by invitation. While it is:
- it is free, and you won't be charged unless you choose a paid plan after testing ends
- features may change, break or be removed, and the service may be unavailable at times
- your data may be cleared, and the database is not backed up, so keep your own copies of anything you need
- please use made-up client details, not real clients' information
- don't rely on Suvi as your only record of invoices, shifts or notes
- you agree to keep what you see confidential and not share access with others

Your account
- Give accurate details and keep your business details up to date, because they appear on your invoices.
- You sign in with codes and links sent to your email, so your account is only as secure as your email. Protect it, and tell us straight away at [to confirm: contact email] if you think someone else has accessed your account.
- One account is for one business. Don't share your sign-in with others.
Plans, payment and cancelling
This section applies once paid plans start. We will tell you the prices and what each plan includes before you are asked to pay.
- Prices are in Australian dollars and include GST.
- Plans are paid in advance, monthly or yearly, and renew automatically until you cancel. Before a yearly plan renews, we email you a reminder with the price.
- You can cancel online in your settings at any time. Your plan then runs until the end of the period you've paid for, and won't renew. There are no cancellation fees and no lock-in contracts.
- We will give you at least 30 days' notice by email before a price increase applies to you. If you don't want to continue, you can cancel before it takes effect.
- If a payment fails, we will tell you and give you at least 14 days to fix it before limiting your account. You can always export your data.
- Refunds are available where the Australian Consumer Law requires them, and if we end your plan early for a reason that isn't your fault, we refund the unused part.
Your invoices and NDIS claims
Suvi helps you work out prices and produce invoices using the published NDIS Pricing Arrangements and the details you enter. It is a tool, not advice.
- You are responsible for what you invoice and claim, including choosing the right support items, checking prices and price limits, and making sure supports are in the person's plan and service agreement.
- Check each invoice before you send it. NDIS rules and prices change, usually each 1 July, and a calculation can be wrong if the details entered are wrong or a rule changes.
- You are responsible for your GST, tax and record-keeping obligations, including keeping NDIS records for 7 years.
- The service agreement template is a plain-English starting point. Check it suits your situation and your clients before you send it; it isn't legal advice.
- When you ask Suvi to email invoices, reminders or agreements, you are responsible for who they go to and what they say.
- We don't give financial, tax, legal or NDIS compliance advice, and we can't guarantee that a plan manager, the NDIA or anyone else will accept or pay an invoice.

Your data
"Your data" means everything you put into Suvi, including your clients' information, shifts, notes and invoices. You own it. You give us permission to store and process it only to provide Suvi to you.
For your data, we promise to:
- use it only to provide Suvi to you and as you instruct, and never sell it, use it for advertising, or use your clients' information to train AI
- keep it stored in Australia, using the service providers listed in our privacy policy (Supabase, Vercel, Resend, Geoscape, Stripe), and tell you before adding a provider that handles client information
- protect it with reasonable security, and limit access to the people who run Suvi, only when needed to support you, keep Suvi secure or comply with the law
- tell you within 72 hours if we become aware that it may have been accessed or lost without authorisation, and help you respond
- help you deal with requests from your clients to see or correct their information
- let you export it at any time in common formats (for example CSV and PDF)
- when your account closes, keep it for 90 days so you can export it, then delete it (it leaves backups within a further 30 days)
Your clients' information
When you enter information about other people, you confirm that:
- you are allowed to collect it and to use Suvi to store it
- you have told them how you handle their information (our sample notice can help), and you have their consent to record health or disability information
- you only record what you need, and keep it accurate
- you will comply with the privacy laws that apply to you, including the Australian Privacy Principles and, where relevant, state health records laws and the NDIS Code of Conduct
Acceptable use
Don't use Suvi to:
- make false, inflated or fraudulent claims or invoices
- store information you have no right to hold, or anything unlawful
- try to access other accounts or data, test or break our security, or overload the service
- copy, resell or reverse engineer Suvi, or build a competing product from it
- send spam or harass anyone
Changes to Suvi and availability
We keep improving Suvi, which means features can change. If we remove something important you are paying for, we will tell you at least 30 days before, and you can cancel and get a refund of the unused part of your plan. We aim to keep Suvi available all the time, but there will sometimes be maintenance or outages, and we'll keep these as short as we can.
Our software and your feedback
We own Suvi, its design and its software. You may use it while your account is open, under these terms. If you send us ideas or feedback, we may use them to improve Suvi without paying you or naming you; we won't share your data or identify you publicly without asking.
Your rights under consumer law
Our services come with guarantees that can't be excluded under the Australian Consumer Law, including that they will be provided with due care and skill. Nothing in these terms excludes, restricts or changes those rights, or any other right you have that can't legally be changed by agreement.
Limits on liability
- Where the law allows us to limit our liability for failing to meet a consumer guarantee, our liability is limited to supplying the services again or paying the cost of having them supplied again.
- Otherwise, and as far as the law allows, neither of us is liable to the other for indirect losses (such as lost profits), and each party's total liability under these terms is limited to the amount you paid us in the 12 months before the claim, or $100 if that is more.
- These limits don't apply to fraud, wilful misconduct, a breach of our promises about your data caused by our negligence, or anything else that can't legally be limited.
- We aren't responsible for losses caused by information you enter, invoices you choose to send, or things outside our reasonable control, such as a failure of the internet or of a provider we rely on, provided we have taken reasonable care.
Suspension and closing accounts
- You can close your account at any time from your settings, or by emailing [to confirm: contact email].
- We may suspend or close an account that seriously breaches these terms (for example fraud or a security threat). Unless it's urgent or unlawful to do so, we will tell you first and give you at least 14 days to fix the problem.
- If we decide to stop offering Suvi, we will give you at least 60 days' notice and refund any unused part of your plan.
- However your account ends, you can export your data for 90 days afterwards, as described in your data.
Changes to these terms
We may update these terms. For changes that matter, we will email you at least 30 days before they take effect. If you don't agree, you can close your account before then and we will refund the unused part of your plan. Small changes that don't affect you badly, like fixing typos, may take effect straight away.
General
- These terms are governed by the law of Queensland, Australia, and the courts of Queensland and the Commonwealth can hear disputes. If there's a problem, please contact us first so we can try to sort it out.
- We may send notices to the email address on your account. You can send notices to [to confirm: contact email].
- If part of these terms can't be enforced, the rest still applies.
- We may transfer these terms to someone who takes over Suvi, provided your rights under them don't reduce. We will tell you if this happens.
